(1) If a party suffers any kind of loss due to a vehicle accident, the driver, owner or manager of the vehicle must pay the expenses and compensation to the injured party as follows:-
(a) In case of death, up to fifty thousand rupees for legal expenses and the amount of accident insurance that the third party will get according to this Act, if the third party insurance is not taken out for compensation.
(b) If a third party has not been insured for the compensation of a dismembered limb, if he is unable to work even after recovery, the amount of accident insurance due to the third party according to this Act, and if such dismemberment becomes functional, from twenty-five thousand to fifty thousand rupees for the expenses.
(2) If a person dies due to a vehicle accident, the chief district officer shall immediately pay the expenses and compensation amount to the deceased person's rightful owners, and if the person is disabled, the compensation amount shall be paid by the driver, owner or manager of the vehicle as per sub-section (1). > (3) Apart from what is written in sub-section (1), if the driver causes an accident and causes injury to any person in violation of this Act or the rules made under this Act, the Chief District Officer shall consider the situation of the injury and pay medical expenses to such person immediately. Twenty five thousand rupees should be given from the vehicle owner or manager. If the person suffering from such injuries receives more compensation later, the amount given for the medicine expenses will be deducted and only the remaining amount will be given.
(4) Notwithstanding anything written above in this section, no more than five percent of the total amount of road expenses, operating expenses and compensation to be paid according to this section shall be paid by the driver.
(5) If the driver is required to pay the action expenses, road expenses and compensation amount to be paid according to sub-section (1) or (2), if he fails to pay it, it cannot be recovered from his property according to the prevailing law, if it is not paid, the amount of rupees collected from the fine is collected from him. (6) As written in this section, the insurance company should pay the insurance amount for the compensation as soon as possible.
